Whether it be initial start-up costs or finance required to begin expansion, if a business loan is needed this process is not always as straight forwards as one may assume.

Most lenders will require some form of guarantee to be put against the loan, and this can be personal or business assets, or a personal guarantor. This may appear to be simple in its premise, however the reality is that should there be any form of default against a loan repayment, assets can be seized or guarantors called upon, which can in turn result in their personal assets being at risk if they do not have the monies available.

Loan and repayment terms are easy to agree to in the beginning, as most businesses will have a secure plan in progress to allow them to work out realistically achievable repayments. However, there are a huge number of unforeseen circumstances that can occur at any point which may hinder the plan being executed successfully. In case such a situation does arise it is sensible from the outset to obtain independent legal advice to protect all those involved as much as possible where necessary.
